Terms of Service

These Terms of Service ("Terms") govern your use of the Curtify application and related services operated by Autel Consultancy ("we", "us", "our"). By creating an account or using Curtify, you agree to be bound by these Terms.

1. Service Description

Curtify is an AI-powered automotive diagnostic and consultation assistant. The service includes:

• AI-assisted vehicle diagnostics and troubleshooting
• VIN decoding and module data analysis
• Parts search and compatibility checking
• Voice consultation with real-time transcription
• Screen capture analysis for diagnostic software
• Procedure extraction and knowledge retrieval
• Consultation session management and history

Curtify is available as a desktop application (Windows) and a mobile application (iOS and Android).

2. Account Registration

To use Curtify, you must create an account with a valid email address. You agree to:

• Provide accurate and complete registration information.
• Keep your login credentials secure and confidential.
• Notify us immediately at support@curtify.app if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. Subscription and Billing

3.1 Plans and Pricing

Curtify offers free and paid subscription plans. Paid features, pricing, and plan details are displayed within the application and on our website. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

3.2 Payment Processing

All payments are processed securely by Stripe. By subscribing to a paid plan, you authorize Stripe to charge your selected payment method on a recurring basis according to your plan's billing cycle.

3.3 Cancellation

You may cancel your subscription at any time from within the app or by contacting support@curtify.app. Upon cancellation:

• You retain access to paid features until the end of your current billing period.
• No partial refunds are issued for unused time within a billing period.
• Your account reverts to the free plan after the billing period ends.

3.4 Refunds

Refund requests are evaluated on a case-by-case basis. Contact support@curtify.app within 14 days of a charge if you believe a refund is warranted.

4. Acceptable Use

You agree not to use Curtify to:

• Violate any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or extract source code from the application.
• Interfere with or disrupt the service, servers, or networks connected to the service.
• Upload malicious content, viruses, or harmful code.
• Use automated scripts, bots, or scrapers to access the service without our permission.
• Resell, sublicense, or redistribute access to Curtify without written authorization.
• Share your account credentials with others or operate a single account for multiple users.
• Use the service for any purpose unrelated to automotive diagnostics and consultation.

Violation of this section may result in immediate account suspension or termination.

5. AI-Generated Content Disclaimer

By using Curtify, you acknowledge and agree that:

• AI-generated responses are informational suggestions only, not professional advice.
• You are solely responsible for verifying all diagnostic information, repair procedures, torque specifications, part numbers, and other technical data before acting on them.
• Curtify does not guarantee the accuracy, completeness, or timeliness of any AI-generated content.
• You assume all risk associated with relying on AI-generated information for vehicle repair or maintenance.
• We are not liable for any damages, injuries, or losses resulting from actions taken based on AI-generated content.

6. Intellectual Property

6.1 Our Property

The Curtify application, its design, code, branding, logos, and documentation are the intellectual property of Autel Consultancy. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the service.

6.2 Your Content

You retain ownership of the data you input into Curtify, including session notes, uploaded images, and vehicle information. By using Curtify, you grant us a limited license to process this data solely to provide and improve the service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the service, we may use them without obligation to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• Curtify is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
• In no event shall Autel Consultancy, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.
• Our total cumulative liability to you for all claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Autel Consultancy and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

9. Termination

9.1 By You

You may delete your account at any time from within the application or by emailing support@curtify.app. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy.

9.2 By Us

We may suspend or terminate your account if:

• You breach these Terms.
• We are required to do so by law.
• We discontinue the service (with reasonable notice).

If we terminate your account without cause, you will receive a pro-rata refund for any prepaid subscription fees.

9.3 Survival

Sections 5 (AI Disclaimer), 6 (Intellectual Property), 7 (Limitation of Liability), 8 (Indemnification), and 10 (Governing Law) survive termination of these Terms.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.

Any disputes arising from these Terms or your use of Curtify shall be resolved in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts.

Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at support@curtify.app. We will make good-faith efforts to resolve the matter within 30 days.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.

12. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Autel Consultancy regarding the service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
• Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
